In a diversity case, federal trial courts are required to apply a state law standard when considering a motion for a new trial based on the excessiveness of the verdict.

Federal  trial courts only have limited jurisdiction, so they can only consider matters that are specifically allowed by the US Constitution or federal law. Any matter originating under federal laws, the Constitution, or treaties must be filed with the federal district court.

If a move for judgement (Rule 50(a)) is denied, the court is said to have sent the case to the jury with the understanding that the court would subsequently resolve the legal issues brought by the motion.

The movant may file a renewed motion for judgement as a matter of law and may include an alternative or joint request for a new trial under Rule 59 no later than 28 days following the entry of judgment—or, if the motion addresses a jury issue not resolved by a verdict, no later than 28 days after the jury was discharged.
