Why did it take 38 years from the time Luther wrote his 95 theses until Lutheranism was accepted at the peace of Augsburg

It took that long because there was a war between protestants and christians following Luther's writing of the 95 theses which was very gruesome. After this war subdued, the church was finally ready to accept peace.
