John Marshall argued that acts of Congress in warfare with the charter aren't regulated and consequently are non-binding to the courts and that the judiciary's first responsibility is continuing to uphold the charter.

Marshall reasoned that the Judiciary Act of 1789 conflicted with the constitution. Congress did no longer have the energy to regulate the charter through ordinary law because Supremacy Clause places the charter earlier than the laws.

In a landmark case, Marbury v. Madison (1803), Marshall dominated that acts of Congress can be reviewed and struck down if the courtroom deems them to be unconstitutional.
