When a medicare claim is appealed, the final fifth level of the appeal process is the Federal District Court Appeal. Parties dissatisfied with the Medicare Appeals Council's judgment may ask a Federal Court to examine it.
The appellant party has the option to take the appeal to the Federal Court if the adjudication term for the Council to finish its review has passed and the Council is unable to render a judgment, dismiss the matter, or remand it to OMHA.
Within 60 days of the day it gets notice of the Council's decision, parties who are dissatisfied with it may file a petition for review in Federal Court. The amount still in dispute must reach the yearly threshold requirement, which for 2022 is $1,760, in order to file a petition for judicial review. This is the last level of appeal.
