Initially, this problem was solved by the Missouri Compromise. However, after the Missouri Compromise was negated by the Compromise of 1850, Congress was troubled on whether or not new territories applying for statehood should allow slavery. Instead of Congress deciding for themselves, they let the people decide.

The Kansas Nebraska Act (1854) was a law passed by Congress that stated that the citizens of Kansas and Nebraska will get to vote on whether they will allow slavery once admitted as a state into the union. Letting the citizens vote, also known as popular sovereignty, became a huge problem. There was voter fraud and fighting between two different political groups, which resulted in violence and death. The two different political groups were anti-slavery citizens and citizens in favor of slavery. The fight raged on and ultimately Kansas would enter the Union as a free state right before the beginning of the Civil War.
