Expressed powers  

  • They are also called enumerated or delegated power, they are specifically delegated by the constitution. These are powers that only belongs to the central government.

They include;

Concurrent powers  

  • They are powers that are shared by both central government and the state government.
  • Concurrent powers include: collection of taxes, borrowing and spending money, making laws, etc.

Reserved powers  

  • These are powers that only belong to the state governments. These powers are reserved to the states and allows the states to legislate and control to protect the safety, health and morals of its people.
  • Examples of reserved powers are, zoning laws, state criminal laws, and environmental protection among others.  

Prohibited powers  

  • These are powers that are denied to the national or state governments or both.
  • For instance, the central government cannot exercise its power that would interfere with the ability of the state governments to undertake their duties.

United States has defined many powers to the Congress. Some of the expressed powers of the congress are to admit new states, Powers related to Taxies, Custom duties, Imports and exports and many more such powers are there.

Congress has all the major decision taken powers as far as United States is concerned. The constitution of United States gives these powers to the congress. Congress has powers to admit new state to the country by bringing a motion and voting on it after the discussion. All the legislative decisions are taken by Congress in United States. Another important role of Congress is to establish the rule of naturalization and Uniform laws on subject to Bankruptcies throughout the country.

Under section 3 of article 4 of the constitution of United States, Congress has expressed power to form any new state. But those new states should not be formed or erected within the jurisdiction of any other present state. Any new state can also not be formed by merging of two old states without the consent of legislatures and Congress. Only the state of ‘Texas’ has exception to create up to 4 additional territories as it was an independent republic before it adopted the constitution of United States. Once the request with regards to new state is made, the discussion takes place in Congress and upon the approval of the Congress, The new state is then sent to President for proclamation which certifies entry of a new state in United States of America.
