In the case of Dred Scott, he was brought by his owner to the north. When there, he sued for his freedom, claiming that now that they were in a free state, his owner did not have the right to still 'own' him, since it was illegal in the state. However, the judge ruled that property continued to stay as property regardless of where the property is located at.
