Dred Scott is often considered the worst ruling ever handed down by the Supreme Court. Jurists lament its poor logic to start with. Basically what it determined is that free or slave, African Americans could not sue in a federal court and that the Federal government did not have the power to ban slavery in the territories.
What is tortured here is the idea of freedom. The colored, even the "free," were denied citizenship.
