Well the 8th amendment does not allow the federal government to impose excessive bail, excessive fines, or cruel and unusual punishments. This means if someone is guilty, they are sometimes (if the judge allows it) allowed to have bail, but the amendment states it can't be excessive. Also, the amendment protects criminals from cruel punishments that used to occur before the amendment was put in place.  
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. Basically the punishment must fit the crime
