After reviewing Defendant's motion, the Court would stay the motion given that Defendant has filed a notice of appeal (Docket No. 62). See United States v. Deeb, 944 F.2d 545, 548 (9th Cir. 1991) ("[A] district court should notentertain a habeas corpus petition while there is an appeal pending in this court or in the Supreme Court."). After the conclusion of Defendant's pending appeal, or if Defendant can show extraordinary circumstances warranting prior consideration, Defendant is free to file or renew any motion for reduction of his sentence.
