McCullough Partnership. The agreement was for Dairy Queen to settle a $150,000
debt to the McCullough Partnership. When Dairy Queen missed several payments,
The McCullough Partnership sued for Breach of Contract. In front of a District
Judge, the McCollough Partnership asked for a jury trial. Dairy Queen, asked the
judge to strike or disregard the request for a jury trial. The judge sided with Dairy
Queen and did not require a jury. The McCollough Partnership appealed this
decision and won.
