Disparate Treatment is when employees are treated differently due to Sex, disability, race etc. and are treated differently on purpose with no regard to the relationship of the job. Disparate Impact is when an employer's practices affect a group or groups of employees unintentionally and in a nondiscriminatory way that leads to the group being underrepresented in employment decisions. “There are two types of discrimination recognized by our various civil rights laws: disparate treatment and disparate impact. The former is conscious, intentional discrimination. Treatment vs Impact are not similar in any way, one is deliberate why the other is unintentional. You cannot compare two concepts that have different outcomes due to process. When you make decisions in the best interests of the company you are not excluding anyone who is unbale to do the job.
